These terms are the agreement between you and Vigil. We have tried to write them like a human being wrote them, because you should be able to read them.
By using Vigil, you agree to these terms. If you do not agree, please do not use the app. If you are using Vigil on behalf of an organization, you confirm you are authorized to accept these terms for it.
You must be at least 13 years old. If you are under the age of majority where you live, you should have a parent or guardian's permission to use the app.
You can begin using Vigil without creating a saved account. That account lives only on your device: if you delete the app, change phones, or lose the device without first saving your account, that account and everything in it is gone permanently, and we cannot recover it for you. Saving your account by connecting an email address or an Apple or Google account is what makes it recoverable. You are responsible for keeping access to whatever account you connect.
You keep ownership of the prayers and other content you write. You grant us a limited, worldwide, royalty-free license to store, reproduce, and display that content solely in order to operate the app in the way you directed — meaning, to show it to the audience you chose for it, whether that is everyone, a circle, or only you. We do not use your content to advertise, and we do not license it to anyone else.
You are responsible for what you write. Please only write things you have the right to share — including other people's private circumstances. Consider whether the person you are praying for would want their situation described to strangers.
Prayers shared publicly pass through automated filtering, and we may review reported content. We may remove content or suspend or terminate an account that violates these terms, and we will try to be fair and proportionate when we do. You can report content from within the app.
Vigil is a space for prayer. It is not medical, mental health, legal, or financial advice, and it is not a crisis service or a substitute for professional care. If you are in danger or in crisis, please contact your local emergency number or a crisis line right away. Nothing in the app should delay you seeking real help.
We may change, add, or remove features, and we may suspend or discontinue the service. We will give reasonable notice of a significant change where we can. Vigil depends on other services and on your device and network; we cannot promise it will always be available or uninterrupted.
You can stop using Vigil at any time and delete your account from Settings. We may suspend or end your access if you materially breach these terms, or if we stop offering the service. Sections that by their nature should survive — ownership, disclaimers, limitation of liability, and dispute terms — survive termination.
To the fullest extent permitted by law, Vigil is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that content shared by other users is accurate or appropriate.
To the fullest extent permitted by law, Vigil and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
You agree to indemnify and hold harmless Vigil and its operators from claims arising out of your content, your use of the service, or your breach of these terms.
If you obtained Vigil from the Apple App Store: this agreement is between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or to address any claim relating to the app, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-parties list.
These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in the State of New York will have exclusive jurisdiction — except where the law where you live gives you the right to bring a claim elsewhere.
We may update these terms. If a change is significant, we will notify you in the app before it takes effect. Continuing to use Vigil after that means you accept the updated terms.
